1. Acceptance of Terms

Welcome to NoticeServe™ CA ("NoticeServe™ CA," "we," "us," or "our"). By accessing or using our software-as-a-service platform, website, mobile applications, or related services (collectively, the "Services"), you agree to be bound by these Terms of Use.

If you do not agree to these Terms, you may not use the Services.


2. Description of Services

NoticeServe™ CA provides software tools designed to assist landlords, property managers, attorneys, and registered process servers with:

  • Creating tenant and /or client notifications

  • Managing notice preparation workflows

  • Tracking service attempts

  • Document storage and management

  • Electronic recordkeeping

  • Process serving coordination

  • Compliance workflow assistance

NoticeServe™ CA is a technology platform only and does not provide legal advice.


3. Eligibility

You must be at least eighteen (18) years old and legally authorized to enter into binding agreements to use the Services.

By using the Services, you represent that all information provided is accurate, complete, and current.


4. User Responsibilities

Users are solely responsible for:

  • The accuracy of all information entered into the platform

  • Verifying tenant and /or client information

  • Selecting the appropriate legal notice

  • Compliance with applicable federal, state, and local laws

  • Determining whether service of process complies with legal requirements

  • Ensuring documents are legally sufficient

  • Reviewing all notices before service or delivery

NoticeServe™ CA does not review, verify, or validate the legal accuracy of user-generated notices.


5. No Legal Advice

NoticeServe™ CA is not a law firm.

Nothing contained within the Services constitutes:

  • Legal advice

  • Legal representation

  • An attorney-client relationship

  • A legal opinion

Users should consult qualified legal counsel regarding specific legal matters.


6. Landlord and Property Manager Obligations

Landlords and property managers remain solely responsible for:

  • Compliance with California Civil Code requirements

  • Compliance with local rent control ordinances

  • Compliance with tenant protection laws

  • Accuracy of notices generated through the platform

NoticeServe™ CA does not guarantee that any notice is legally enforceable or sufficient for eviction proceedings or any other legal action.


7. Process Server Responsibilities

Process servers using the Services are solely responsible for:

  • Maintaining any licenses or registrations required by law

  • Completing service in compliance with applicable laws

  • Maintaining accurate service records

  • Ensuring proof of service documentation is complete and accurate

  • Confirming that all service attempts and declarations are truthful and legally compliant

NoticeServe™ CA does not supervise, direct, or control individual service activities.


8. Electronic Communications

By using NoticeServe™ CA, you consent to receive:

  • Service notifications

  • Security alerts

  • Account communications

  • Billing notices

  • Operational updates

Such communications may be transmitted electronically.


9. User Accounts

Users are responsible for safeguarding account credentials.

You agree to:

  • Keep login information confidential

  • Notify us immediately of unauthorized access

  • Accept responsibility for all activity occurring under your account


10. Fees and Billing

Certain Services require payment.

Users agree to:

  • Pay all fees when due

  • Maintain valid payment information

  • Authorize recurring billing where applicable

Fees are non-refundable except as required by applicable law.


11. Acceptable Use

You agree not to:

  • Upload malicious code

  • Interfere with platform operations

  • Access accounts without authorization

  • Upload false, misleading, or fraudulent information

NoticeServe™ CA reserves the right to suspend or terminate accounts for violations of these Terms.


12. Data and Records

Users retain ownership of documents uploaded to the platform.

You grant NoticeServe™ CA a limited license to:

  • Store

  • Process

  • Display

  • Transmit

such data as reasonably necessary to provide the Services.


13. Privacy

Use of the Services is subject to our Privacy Policy.

By using the Services, you consent to our collection, use, and processing of information as described in the Privacy Policy.


14. Service Availability

We strive to maintain reliable service but do not guarantee uninterrupted availability.

Services may be unavailable due to:

  • Scheduled maintenance

  • Emergencies

  • Internet outages

  • Third-party service interruptions

  • Hardware or software failures


15. Disclaimer of Warranties

THE SERVICES ARE PROVIDED "AS IS" AND "AS AVAILABLE."

TO THE MAXIMUM EXTENT PERMITTED BY LAW, NOTICESERVE™ CA DISCLAIMS ALL WARRANTIES, WHETHER EXPRESS OR IMPLIED, INCLUDING:

  • MERCHANTABILITY

  • FITNESS FOR A PARTICULAR PURPOSE

  • NON-INFRINGEMENT

  • ACCURACY OF CONTENT

  • LEGAL SUFFICIENCY OF DOCUMENTS

  • UNINTERRUPTED OR ERROR-FREE SERVICE


16. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, NOTICESERVE™ CA SHALL NOT BE LIABLE FOR:

  • LOST PROFITS

  • LOST RENTAL INCOME

  • LOST BUSINESS OPPORTUNITIES

  • EVICTION DELAYS

  • COURT REJECTIONS

  • INDIRECT DAMAGES

  • INCIDENTAL DAMAGES

  • CONSEQUENTIAL DAMAGES

  • LOSS OF DATA OR RECORDS

IN NO EVENT SHALL NOTICESERVE™ CA'S TOTAL LIABILITY EXCEED THE AMOUNT PAID BY THE USER DURING THE TWELVE (12) MONTHS PRECEDING THE CLAIM.


17. Indemnification

Users agree to defend, indemnify, and hold harmless NoticeServe™ CA and its owners, officers, employees, contractors, and affiliates from any claims, liabilities, damages, losses, or expenses arising from:

  • User content

  • Notice preparation

  • Service of process activities

  • Violations of law

  • Violations of these Terms

  • Reliance upon user-generated documents


18. Intellectual Property

All software, source code, logos, trademarks, service marks, designs, content, and platform functionality remain the exclusive property of NoticeServe™ CA.

No ownership rights are transferred to users.


19. Termination

NoticeServe™ CA may suspend or terminate access at any time for violations of these Terms or for any activity that threatens the security or integrity of the Services.

Users may discontinue use of the Services at any time.


20. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the State of California, without regard to conflict of law principles.

Any dispute arising from these Terms or the Services shall be brought exclusively in the state or federal courts located within the State of California.


21. User Responsibility for Record Retention and Backups

While NoticeServe™ CA uses commercially reasonable efforts to preserve application data, users are solely responsible for maintaining independent copies of all legal records, proofs of service, declarations, photographs, GPS records, service attempts, tenant and /or client notices, court documents, and other evidence generated through the Services.

NoticeServe™ CA may provide optional integrations with third-party cloud storage providers, including Google Drive, Microsoft OneDrive, Dropbox, and similar services, for backup and storage purposes. Users are encouraged to enable, monitor, and regularly verify such backups.

NoticeServe™ CA does not own, operate, or control third-party cloud storage providers and does not guarantee the availability, retention, security, integrity, recoverability, or permanent preservation of any records stored through such services.

Users acknowledge and agree that they retain sole responsibility for maintaining adequate backup procedures and ensuring all records required for legal proceedings, regulatory compliance, business operations, or evidentiary purposes are properly preserved.

NoticeServe™ CA shall not be liable for any loss, corruption, deletion, unavailability, destruction, alteration, or inability to retrieve data, whether caused by software failure, hardware failure, internet interruption, cloud provider outage, account suspension, user error, unauthorized access, cyberattack, natural disaster, or any other cause.


22. Changes to Terms

NoticeServe™ CA may modify these Terms at any time.

Updated Terms will be posted on the website and become effective upon publication. Continued use of the Services after such changes constitutes acceptance of the revised Terms.
