4. User Responsibility

5. Photographs, Signatures, GPS Data, and Documentation Records

The App may collect and store:

  • Service photographs

  • GPS coordinates

  • Date and time records

  • Electronic signatures

  • Metadata associated with uploaded files and photographs

These records are generated solely for documentation and recordkeeping purposes.

NoticeServe™ CA does not represent or warrant that such records constitute legal proof or satisfy evidentiary requirements in any jurisdiction.

Users are solely responsible for determining whether such records satisfy legal requirements applicable to their specific circumstances.


6. Location Information (GPS Data)

To support the creation and documentation of service records, proofs of service, and notice delivery records, the App may collect location information from the user's device when location-related features are utilized.

Location information may include:

  • GPS coordinates

  • Device location

  • Date and time of location capture

  • Property location associated with a service event

  • Metadata associated with photographs

Location information is collected solely for:

  • Notice preparation

  • Notice posting

  • Notice delivery

  • Service attempts

  • Proof-of-service generation

  • Recordkeeping

  • Related business functions

The App does not continuously track users and does not monitor user location when the App is closed or when location-related features are not actively being used.

Location data may be incorporated into reports, notices, declarations, affidavits, proofs of service, and other records generated by users.

Users are responsible for obtaining any legally required consent before collecting, recording, transmitting, or relying upon location information.

To the fullest extent permitted by law, NoticeServe™ CA makes no representation or warranty regarding the accuracy, precision, reliability, admissibility, or legal sufficiency of any location information generated by the App.

GPS signals, cellular networks, internet connectivity, device settings, and third-party services may affect location accuracy.


7. Data Storage and Security

All information submitted through the App is stored and processed using cloud infrastructure and services provided by Base44 and other authorized service providers.

NoticeServe™ CA relies on Base44's hosting environment and security controls to help protect user information from unauthorized access, disclosure, alteration, or destruction.

We implement commercially reasonable administrative, technical, and organizational safeguards designed to protect information, including:

  • Authentication controls

  • Access restrictions

  • Encryption technologies

  • Secure cloud infrastructure

  • Security monitoring practices

Despite these safeguards, no method of electronic transmission or storage is completely secure.

Accordingly, NoticeServe™ CA does not guarantee the absolute security of any information and disclaims liability for unauthorized access, loss, misuse, alteration, theft, corruption, or disclosure of information.

By using the App, you acknowledge and accept the inherent risks associated with electronic communications and cloud-based storage.


8. Cloud Storage and Backup Responsibility

NoticeServe™ CA provides optional integration with third-party cloud storage providers, including but not limited to Google Drive, Microsoft OneDrive, Dropbox, and similar services, to facilitate the storage, synchronization, and backup of user data.

While NoticeServe™ CA may assist in transferring, organizing, or storing information within a user's selected cloud storage account, NoticeServe™ CA does not own, control, or guarantee the availability, retention, integrity, security, recoverability, or continued accessibility of any data stored with third-party cloud service providers.

Users and organizations remain solely responsible for:

  • Maintaining appropriate backup procedures

  • Verifying successful backups

  • Ensuring records are recoverable

  • Retaining copies of important legal records

  • Preserving records required for court proceedings, compliance, or business operations

NoticeServe™ CA makes no representation or warranty that any backup, synchronization, transfer, or storage operation will be uninterrupted, error-free, complete, or successful.

Users acknowledge that technical failures, cloud provider outages, internet disruptions, software defects, user error, account suspensions, cyberattacks, or other unforeseen events may result in data loss, corruption, delay, or unavailability.

To the fullest extent permitted by law, NoticeServe™ CA shall not be liable for any loss of data, business interruption, loss of records, regulatory penalties, legal claims, or damages arising from the use of third-party cloud storage services or the failure to maintain independent backups.

By using backup and cloud storage features, users acknowledge and agree that they retain ultimate responsibility for the protection, retention, backup, and recovery of their data.


9. No Legal Advice

NoticeServe™ CA is a document-generation and recordkeeping platform only.

Nothing within the App constitutes:

  • Legal advice

  • Legal representation

  • Property management advice

  • Process serving advice

  • An attorney-client relationship

  • A legal opinion

Users should consult qualified legal counsel regarding notice requirements, landlord-tenant laws, service procedures, and legal compliance.


10. Retention of Information

Information may be retained as long as reasonably necessary to:

  • Provide Services

  • Comply with legal obligations

  • Resolve disputes

  • Enforce agreements

  • Maintain business records

Users may request deletion of information, subject to legal, contractual, regulatory, and operational requirements.

 

11. Data Retention Upon Cancellation or Termination

Upon cancellation, expiration, non-renewal, suspension, or termination of a user's subscription, NoticeServe™ CA may disable access to the user's account and associated data.

Users are solely responsible for exporting, downloading, and retaining copies of all notices, proofs of service, declarations, photographs, GPS records, timestamps, tenant/client information, reports, and other records prior to cancellation or termination of their subscription.

Unless otherwise required by law, NoticeServe™ CA has no obligation to retain, store, archive, recover, or provide access to user data after cancellation or termination of an account.

Following cancellation or termination, user data may be permanently deleted from NoticeServe™ CA systems, Base44 cloud infrastructure, backup systems, third-party storage providers, and related service providers without further notice.

NoticeServe™ CA does not guarantee the availability, recovery, restoration, or retrieval of data following cancellation or termination of a subscription.

Users acknowledge and agree that NoticeServe™ CA shall have no liability for the deletion, loss, destruction, or inability to recover any data following cancellation, expiration, suspension, or termination of Services.

It is the user's sole responsibility to maintain independent backups of all records required for legal proceedings, regulatory compliance, business operations, or evidentiary purposes.


12. Additional Limitation of Liability

To the fullest extent permitted by law, NoticeServe™ CA shall not be liable for any loss, claim, damage, expense, or liability arising from:

  • Failures of Base44 or other third-party providers

  • Data breaches occurring within third-party systems

  • Cloud storage interruptions

  • Service outages

  • Data loss or corruption

  • Unauthorized access

  • Delays in transmission or processing

  • Software failures

  • Hardware failures

  • Internet disruptions

  • GPS inaccuracies

  • Camera malfunctions

  • Communication failures

  • User errors

Electronic records, photographs, timestamps, GPS data, and electronic signatures are provided solely as documentation tools and are not guaranteed to satisfy evidentiary, statutory, court, regulatory, or legal requirements in any jurisdiction.


13. California Privacy Rights

California residents may have certain rights regarding their personal information under applicable California privacy laws.
